Terms of Service

These terms govern your use of Bantertalks ("the Service"), operated from bantertalks.com. By creating an account, embedding a chatbox on your site, or chatting on a Bantertalks-powered room, you agree to these terms. If you don't agree, don't use the Service.
1. Who can use the Service
You must be at least 13 years old to create an account. If you're using the Service on behalf of an organisation, you confirm you have authority to bind that organisation.
2. Your account
- Keep your password (or Google account) secure. You're responsible for activity under your account.
- One account per person. Don't impersonate someone else.
- We may suspend or terminate accounts that violate these terms.
3. Acceptable use
You agree NOT to use Bantertalks (whether as an account holder, chatbox owner, moderator, or guest) to:
- Post unlawful, defamatory, harassing, threatening, hateful, or discriminatory content.
- Post sexual content involving minors, or any other content prohibited by law.
- Spam, flood, or run automated scripts that disrupt the Service.
- Distribute malware, phishing links, or content designed to harm others.
- Infringe intellectual property rights (including reposting copyrighted material you don't have the right to share).
- Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure.
- Use the Service for any activity that violates applicable law.
Chatbox owners are responsible for moderating their rooms. We provide moderation tools (bans, slow-mode, auto-mod filters, content blocklists); using them is up to you. We may remove content or close chatboxes that violate these terms, at our sole discretion.
4. Embedding the chat
You may embed Bantertalks chatboxes on any website you own or operate, subject to these terms. The embed must remain unmodified — don't try to strip our branding (the "Bantertalks" footer link) or impersonate us.
5. Premium features and payments
- Some features (e.g. flag emote pack, Premier League clubs pack) are paid one-time purchases processed by PayPal.
- Purchases are non-refundable except where required by law (UK / EU consumer rights apply where relevant).
- Prices are shown at checkout. We may change prices for future purchases.
- Gifted purchases transfer the entitlement to the recipient's account and cannot be reclaimed by the buyer.
6. Content ownership
You retain ownership of the messages you post. By posting, you grant Bantertalks a worldwide, royalty-free, non-exclusive licence to host, display, and deliver your messages within the Service for the purpose of operating it. You can delete your messages (where moderation tools allow) and we'll honour the deletion within our retention timeframes.
7. Service availability
We aim to keep the Service running but make no uptime guarantee. We may suspend the Service for maintenance, security, or other operational reasons. We may also discontinue features or the entire Service with reasonable notice.
8. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, Bantertalks is not liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for direct damages is capped at the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) GBP 50.
Nothing in these terms limits liability that cannot be limited under applicable law (e.g. for death or personal injury caused by negligence, or fraud).
10. Indemnity
You agree to indemnify and hold Bantertalks harmless from any claims, damages, or expenses arising from your breach of these terms, your content, or your use of the Service.
11. Termination
You can delete your account at any time. We can suspend or terminate accounts that breach these terms, at our discretion. On termination, your account data is deleted in line with our Privacy Policy; backups may persist briefly.
12. Changes to these terms
We may update these terms. Material changes will be announced on the homepage. Continued use after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, unless mandatory consumer protection law in your country of residence requires otherwise.
